Giveaway Rules
By submitting an entry to the Sweepstakes (the “Sweepstakes”), you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Godly Woman 911 and that you satisfy all eligibility requirements.
The Sweepstakes (“Sweepstakes”) is open to all humans age 21 or older at time of entry. Residents of Taiwan, South Korea, Portugal, Italy, Austria, China, Russia, Hong Kong, Greece, France, Japan, Spain, and Czech Republic are not eligible to enter or win. Employees of Godly Woman 911 (the “Sponsor”), its respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, merchants involved with this Sweepstakes, and their immediate family members and/or those living in the same household of each are not eligible to enter or win. The Cayman Islands law will govern the sweepstakes. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. No purchase necessary to enter or win. A purchase will not improve your chances of winning.
HOW TO ENTER
To enter the Sweepstakes, follow all onscreen instructions to complete and submit the online entry form (“Submission”). To be entered into that month’s draw, all entries must be received before the last day of the specific month (“Sweepstakes Entry Period”). Online entrants subject to all notices posted online including but not limited to Sponsor’s privacy policy.
AGREEMENT TO OFFICIAL TERMS AND CONDITIONS
Sponsor’s decisions are final and binding in all matters relating to this Sweepstakes, including, but not limited to, interpretation and application of these Official Rules. By participating in this Sweepstakes, entrants agree to abide by these Official Rules. Any entrant or winner who violates these Official Rules is subject to disqualification at any time at Sponsor’s sole discretion.
ENTRY PERIOD
You may enter a Submission at any time.
PRIZES & APPROXIMATE RETAIL VALUES (“ARV”):
The maximum ARV of all prizes will vary each month as the prize is announced. One winner will be chosen each month. If the winner is unable to receive the prize, then the prize will be forfeited, and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries for that prize. Prizes may not be substituted, transferred, assigned or redeemed for cash. Sponsor will not replace any lost or stolen prizes or components of a prize.
ODDS:
Odds of winning depend on the number of eligible entries received during the Sweepstakes Entry Period.
NOTIFICATION
Winners will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or about the first week of the following month by a representative from the Sponsor whose decisions are final. The potential winner will be contacted, via email, by a Sponsor representative and will be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit”) within five (5) days of prize notification. If any potential winner cannot be contacted within five (5) calendar days or if Affidavit/Release is returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited. It may be awarded to an alternate winner. If a winner is otherwise eligible under these Official Rules but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute affidavit on minor’s behalf. If any potential winner rejects his/her prize or in the event of noncompliance with these Official Rules and requirements, such prize will be forfeited and an alternate potential winner may be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given.
CONDITIONS
No substitutions are permitted except if the prize is unavailable, in which case a prize of equal or higher value will be awarded. The prize is not redeemable for cash and non-assignable and non-transferable except to a surviving spouse. The winner is responsible for all federal, state, local sales and income taxes. Any other incidental expenses on prize not specified herein are the sole responsibility of the winner. Participation in Sweepstakes constitutes entrants’ permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements regarding the Sweepstakes and/or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.
Limit: one prize per household. If Godly Woman 911 goes bankrupt or out of business, then the year they go out of business is the last year of payment for the premium service. If Godly Woman 911 is acquired or merges, it’s the new owner’s discretion to keep paying for the premium service.
ADDITIONAL TERMS
Sponsor, Facebook, Twitter, Instagram and/or their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, suppliers, distributors, advertising and promotional agencies, Sweepstakes administrators, successors, assigns, employees, officers, and directors (collectively “Sweepstakes Entities”) are not responsible for (i) lost, late, misdirected, damaged, illegible or incomplete entries (ii) technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) which may limit one’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in connection with this Sweepstakes. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather, acts of terrorism or any other causes beyond Sponsor’s reasonable control. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the Winner from all eligible entries received before and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or any related website or application. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES
ENTRANTS, WINNERS, AND GUESTS AGREE TO RELEASE AND HOLD HARMLESS THE SWEEPSTAKES ENTITIES FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN SWEEPSTAKES, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, MISAPPROPRIATION, FALSE ASSOCIATION, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY RELATED CAUSE OF ACTION, BREACH OF CONTRACT, AND/OR MERCHANDISE DELIVERY. ENTRANTS AGREE THAT THE SWEEPSTAKES ENTITIES ARE NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE SWEEPSTAKES, AND DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES OR APPLICATIONS ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES, AND THE PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, QUALITY, CONDITIONS, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AS PERMITTED BY LAW. THE SWEEPSTAKES ENTITIES ARE NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE SWEEPSTAKES OR THESE OFFICIAL TERMS AND CONDITIONS OR IN THE ANNOUNCEMENT OF ANY PRIZE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE SWEEPSTAKES ENTITIES SHALL NOT BE LIABLE FOR ANY INABILITY ON THE PART OF THE WINNER OF A PRIZE TO TRAVEL AS SCHEDULED DUE TO WEATHER CONDITIONS, FIRE, NATURAL DISASTER, INDUSTRIAL OR LABOR DISPUTE, WAR, TERRORIST ACTIVITY, HOSTILITIES, POLITICAL UNREST, RIOTS, CIVIL COMMOTION, OR ANY OTHER CIRCUMSTANCES BEYOND THE CONTROL OF THE SWEEPSTAKES ENTITIES.
By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.
Warning: ANY ATTEMPT BY AN individual, whether or not an ENTRANT, TO DELIBERATELY DAMAGE, destroy, tamper or vandalize this WEB SITE OR interfere with the OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS and SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES and diligently pursue all remedies against ANY SUCH individual TO THE FULLEST EXTENT PERMITTED BY LAW.
ARBITRATION:
This Sweepstakes shall be governed by and interpreted under the laws of the Cayman Islands without regard to its conflicts of laws provisions. By participating, For any matters which are not subject to arbitration as outlined in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue in courts sitting in the Cayman Islands. The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the Cayman Islands laws. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the Cayman Islands. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE CAYMAN ISLANDS WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. The parties agree not to raise the defense of forum non-convenience.
WINNERS LIST:
The personal information collected from each entrant in the course of the Sweepstakes will be used by Godly Woman 911 for the administration of the Sweepstakes. If permission were given, data would also be used for marketing, promotions and updates or as otherwise permitted in accordance with Godly Woman 911’s Privacy Policy. Godly Woman 911 reserves the right to alter any rules of any sweepstakes at any time. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
